Legal guarantee
The trader is obliged to deliver to the consumer the goods that comply with the terms and conditions of the contract. Goods are considered to comply with the terms and conditions of the contract if they correspond to the description provided by the trader to the consumer and have the same characteristics as the sample of the goods provided by the trader to the consumer.
In the absence of a description provided by the trader to the consumer, the goods are considered to be in conformity with the terms of the contract if they are suitable for the purpose communicated by the trader to the consumer at the time of entering into the contract and accepted by the consumer.
If the goods are found to be defective, the consumer has a right to require the trader to remedy the defect (replacement of the goods or refund, price reduction) or to withdraw from the contract.
Repair or replacement of goods are the primary rights of the consumer. The consumer has the right to require the trader to repair or replace the goods free of charge, unless this is impossible due to the nature of the goods or requires disproportionate or unreasonable costs.
The consumer shall have the right to request a reduction in the price of the goods or to withdraw from the contract if any of the following conditions exists:
- Replacement of the goods is impossible.
- The trader has not replaced the goods within a reasonable time and the consumer has lost interest in the performance of the contract.
- The consumer will be adversely affected if the trader repairs or replaces the goods.
A consumer shall not have the right to withdraw from a contract if the defects of the goods are insignificant.
If a consumer detects a defect in goods within 6 months after acquiring the physical possession of the goods, the goods shall be deemed defective at the time of delivery if the nature of goods or the defect allows so, unless proved otherwise.
Returning the goods:
In the event of withdrawal from a contract the consumer shall:
- Send back the goods to the trader or a third party designated by the trader, without undue delay and in any event not later than 7 calendar days from notifying the trader of the decision to withdraw from the contract.
- bear only direct costs related to the return of the goods
- If the characteristics of the product do not match the data specified on the website, the product has an original defect, or the product is damaged during transportation, the seller will ensure the return of the product using its own resources.
- The consumer is obliged to return the goods (product), with all accompanying documents.
- The trader is obliged to refund the amount paid by the consumer within 14 calendar days of receiving the notification of the return of the product. The trader has the right to refuse the refund until the goods have been returned or until the trader has received from the consumer proof that the goods have been sent, whichever occurs first.
- The refund will be made using the same payment method used by the customer, unless the customer agrees to use a different payment method.
- To refuse a distance contract by a consumer shall automatically cause the withdrawal from the contract and the restoration of the original condition.
- As a result of the withdrawal from the contract, the obligations assumed by the parties under the distance contract are nullified, and what the parties received through its performance is returned to them.
Return of the goods shall not be possible if:
- The 7 calendar day period, specified in the Georgian Consumer rights Protection Law, has expired.
- Identification of the goods/product is impossible.
- The information/markings on the sold goods/product have been erased or changed.
- The damage has been caused by physical impact.
Delivery Terms for Goods Purchased at the Retail Store:
- Delivery shall be made immediately upon purchase.
- Products purchased during promotional campaigns/sales are non-returnable.
Delivery of Online Orders:
- Delivery shall be completed within a maximum of 30 days (Except for countries where special terms may apply, determined in advance by the shipping company).
- Tbilisi – paid courier delivery.
- Regions – paid courier delivery.
Return of Goods/ products Purchased Online:
- The goods/products may be returned within 14 days.
- The return period shall be calculated from the date of receipt.
- At the time of return, the goods/products must be unused and undamaged.
Force-Majeure:
- Neither party is liable for the full or partial failure to fulfill its obligations if the failure is caused by natural and technological disasters, fire, military action, government decision, and these events occurred or developed after the purchase of the order.
- If any of the above circumstances directly affects the time limit for the performance of a party’s obligations under these Consumer Terms and Conditions, such time limit shall be extended for the duration of the force majeure event.
- The party that has been affected by the force majeure circumstances is obliged to notify the other party about such circumstances, their possible duration and termination.
- Failure to notify or late notification deprives the party of the right to use the above force majeure events as a basis for exemption from liability.
