Legal Warranty

The trader is obliged to deliver goods to the consumer that conform to the terms of the contract.

Goods shall be considered in conformity with the contract if they correspond to the description provided by the trader and possess the same characteristics as the sample or model presented to the consumer by the trader.

Where no description has been provided by the trader, the goods shall be deemed to conform to the contract if they are fit for the specific purpose made known by the consumer to the trader at the time the contract was concluded, provided that the trader accepted such purpose.

If the goods are found to be defective, the consumer has the right to request that the trader remedy the defect (including replacement of the goods, refund, or price reduction) or withdraw from the contract.

Repair or replacement of the goods constitutes the consumer’s primary remedy. The consumer has the right to request that the trader repair or replace the goods free of charge, unless this is impossible due to the nature of the goods or would require disproportionate or unreasonable costs.

The consumer may request a price reduction or withdraw from the contract if one of the following conditions applies:

  • Replacement of the goods is impossible.
  • The trader has failed to replace the goods within a reasonable period, and the consumer has consequently lost interest in the performance of the contract.
  • Replacement by the trader would cause significant inconvenience to the consumer.

The consumer may not withdraw from the contract if the defect is minor.

If the consumer discovers a defect within six (6) months from the date of receiving the goods, it shall be presumed, unless proven otherwise, that the defect existed at the time of delivery, provided that such presumption is compatible with the nature of the goods or the nature of the defect.

Return of Goods

In the event of withdrawal from the contract, the consumer shall:

  • Return the goods to the trader or to a third party designated by the trader immediately after notifying the trader of the withdrawal, but no later than seven (7) calendar days.
  • Bear the direct costs associated with returning the goods.
  • If the product characteristics do not correspond to the information provided on the website, if the product has an inherent defect, or if it has been damaged during transportation, the trader shall arrange and bear the cost of the return.
  • Return the goods in full together with all accompanying documents.

The trader shall refund all payments received from the consumer within fourteen (14) calendar days after receiving notice of the return. The trader may withhold the refund until the goods have been received or until the consumer provides proof that the goods have been returned, whichever occurs first.

The refund shall be made using the same method of payment used by the consumer unless the consumer expressly agrees to another method.

Withdrawal from a distance contract automatically terminates the contract and restores the parties to their original positions.

Following withdrawal from the contract, all obligations arising from the distance contract shall cease, and each party shall return everything received under the contract.

Return of Goods Is Not Possible If:

  • The seven (7) calendar-day period established under the Law of Georgia on Consumer Rights Protection has expired.
  • The goods cannot be identified.
  • Product labels, markings, or identifying information have been removed or altered.
  • The damage has been caused by physical impact or misuse.

Delivery Terms for Goods Purchased at the Physical Store

  • Goods are delivered immediately upon purchase.
  • Products purchased during promotional campaigns or sales are non-returnable.

Delivery of Online Orders

  • Delivery is completed within a maximum of thirty (30) days, except for certain countries where delivery timeframes may vary according to the carrier’s predefined conditions.
  • Tbilisi: Paid courier delivery.
  • Regions of Georgia: Paid courier delivery service.

Return of Goods Purchased Online

  • Goods may be returned within fourteen (14) days.
  • The return period is calculated from the date of receipt.
  • Returned goods must be unused and undamaged.

Force Majeure

  • Neither party shall be liable for the total or partial failure to perform its obligations if such failure results from force majeure events, including natural disasters, technological catastrophes, fire, war, governmental decisions, or other circumstances beyond the parties’ reasonable control that arise after the purchase of the order.
  • If any such circumstance directly affects the time for performance of obligations under these Terms and Conditions, the performance period shall be extended for the duration of the force majeure event.
  • The party affected by a force majeure event shall promptly notify the other party of the occurrence, expected duration, and termination of such event.
  • Failure to provide timely notice shall deprive the affected party of the right to rely on force majeure as grounds for exemption from liability.
